Since the mental competence of the person facing the death penalty is key to determining his eligibility for the death penalty, how can a judge legally accept the wishes of the inmate whose mental competency is the issue in question?  Isn't the competency of the judge open to question?    How has the US Supereme Court ruled on this issue?
